Please read these terms carefully before using Crown Fitness facilities and services

1. Acceptance of Terms

By accessing and using Crown Fitness facilities, programs, and services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and Crown Fitness. If you do not agree with any part of these terms, you must not use our facilities or services. Your continued use of our services after any modifications to these terms constitutes acceptance of those changes.

These terms apply to all visitors, members, guests, and others who access or use Crown Fitness facilities, including but not limited to training areas, group classes, personal training sessions, wellness programs, and all related services. We reserve the right to modify these terms at any time, and such modifications will be effective immediately upon posting on our website.

2. Membership and Access

Access to Crown Fitness facilities requires valid membership or authorized guest access. Members must present their membership credentials upon entry and may not transfer or share their membership with others. All members are responsible for maintaining the confidentiality of their account information and for all activities that occur under their membership account.

Crown Fitness reserves the right to refuse service, terminate memberships, or deny access to any individual for any reason, including but not limited to violation of these terms, disruptive behavior, failure to maintain payment obligations, or conduct that may endanger the safety or wellbeing of other members, staff, or property. Membership privileges may be suspended or revoked without refund in cases of policy violations.

3. Facility Usage Rules

All members and guests must follow facility rules and guidelines as posted throughout Crown Fitness locations and as communicated by staff. This includes proper attire requirements, equipment usage protocols, time limits on certain equipment during peak hours, and general conduct expectations. Members are expected to treat all equipment with care, return equipment to designated areas after use, and maintain cleanliness standards.

Crown Fitness maintains the right to establish and enforce rules regarding facility usage, including capacity limits, time restrictions, equipment reservations, and program participation requirements. Violation of facility rules may result in temporary suspension or permanent termination of membership privileges. Members must respect the rights of other users to access facilities and equipment in a fair and equitable manner.

4. Health and Safety

Members acknowledge that physical exercise and fitness activities involve inherent risks, including but not limited to muscle strain, injury, cardiovascular stress, and in rare cases, serious medical events. By using Crown Fitness facilities, you represent that you are in good physical condition and have no medical conditions that would prevent safe participation in fitness activities. You are strongly encouraged to consult with a healthcare provider before beginning any exercise program.

Crown Fitness and its employees, contractors, and agents shall not be liable for any injury, illness, or medical condition arising from or related to use of facilities, participation in programs, or following advice provided by trainers or instructors. Members participate in all activities at their own risk and are responsible for knowing their own physical limitations. Emergency medical services may be contacted on your behalf if staff deems such action necessary for your safety.

5. Personal Training and Group Classes

Personal training sessions and group fitness classes require advance booking and may have specific cancellation policies. Members must provide adequate notice when canceling scheduled sessions to avoid forfeiture of the session. Personal training packages and group class credits typically have expiration dates and cannot be refunded, transferred, or extended beyond stated validity periods except in cases of documented medical necessity or other circumstances approved by management.

Trainers and instructors provide guidance based on generally accepted fitness principles, but individual results may vary. Crown Fitness does not guarantee specific fitness outcomes or results from participation in personal training or group classes. Members are responsible for communicating any injuries, limitations, or medical conditions to their trainers and instructors before each session.

6. Payment Terms

Members agree to pay all applicable fees according to their membership agreement or service contract. Payment methods, billing cycles, and fee structures vary by membership type and are outlined in individual membership agreements. Members authorize Crown Fitness to charge payment methods on file for recurring membership fees, personal training packages, and other services as authorized.

Late payments may result in suspension of membership privileges until account status is current. Returned payments due to insufficient funds or other reasons may incur additional administrative fees. Members are responsible for updating payment information and ensuring sufficient funds are available for scheduled payments. Disputes regarding charges must be raised within thirty days of the transaction date.

7. Cancellation and Refund Policy

Membership cancellation procedures vary by membership type and contract terms. Most memberships require written cancellation notice submitted according to the terms specified in individual membership agreements. Cancellations may be subject to minimum commitment periods, and early termination fees may apply for contracts canceled before completion of the agreed term.

Refunds are generally not provided for unused portions of memberships, personal training packages, or pre-paid services except where required by law or in cases of documented medical necessity preventing continued participation. Service credits and unused session packages typically do not carry cash value and cannot be refunded or transferred to other individuals.

8. Photography and Media Usage

By entering Crown Fitness facilities, you acknowledge that photography, video recording, and other media capture may occur for marketing, promotional, educational, or operational purposes. You consent to being photographed or recorded during your visits and grant Crown Fitness permission to use such images and recordings in promotional materials, social media, websites, and other marketing channels without compensation or approval rights.

If you do not wish to be photographed or included in media content, you must notify staff in writing. However, complete avoidance of incidental inclusion in photographs or videos of facility spaces and group activities cannot be guaranteed. Personal photography and video recording by members within facilities may be restricted to protect the privacy of other members and must comply with posted guidelines.

9. Personal Property and Lockers

Crown Fitness is not responsible for lost, stolen, or damaged personal property on premises. Members are strongly encouraged to use provided lockers with personal locks and to avoid bringing valuables to the facility. Any property left in lockers or facility areas beyond posted time limits may be removed and held in lost and found for a limited period before being discarded or donated.

Day-use lockers must be emptied daily, and items left overnight may be removed without notice. Long-term locker rental may be available for additional fees where applicable. Crown Fitness reserves the right to open and remove contents from lockers if deemed necessary for facility operations, security concerns, or to address abandoned property.

10. Intellectual Property

All content displayed at Crown Fitness facilities and on our website, including but not limited to logos, trademarks, text, graphics, photographs, videos, workout programs, training methodologies, and proprietary systems, are the intellectual property of Crown Fitness or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Members may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use Crown Fitness intellectual property without express written permission. Workout programs, training plans, and instructional materials provided to members are for personal use only and may not be shared, sold, or used for commercial purposes.

11. Code of Conduct

All members and guests are expected to conduct themselves in a respectful, courteous manner that contributes to a positive environment for all users. Behavior that is disruptive, threatening, harassing, discriminatory, or otherwise inappropriate will not be tolerated. This includes but is not limited to verbal abuse, physical intimidation, unwanted advances, offensive language, and any conduct that creates an uncomfortable or unsafe environment for others.

Members must respect the personal space and comfort of other facility users, follow instructions from staff members, and comply with all posted rules and guidelines. Inappropriate behavior may result in immediate removal from the facility and potential membership termination. Crown Fitness maintains a zero-tolerance policy for harassment, discrimination, and threatening behavior of any kind.

12. Minors and Guardians

Minors under the age of eighteen may access Crown Fitness facilities only in accordance with specific age policies and requirements. Parental or legal guardian consent is required for minors to participate in programs or use facilities. Certain areas, equipment, and programs may have minimum age requirements for safety reasons.

Parents or legal guardians are responsible for supervising minors at all times unless the minor is participating in a supervised program with designated staff oversight. Guardian consent forms must be completed and on file before minors can access facilities or participate in programs. Guardians assume full responsibility for ensuring their minor dependents follow all facility rules and safety guidelines.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Crown Fitness, its owners, employees, contractors, agents, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from or related to use of facilities, participation in programs, or reliance on information or advice provided by staff members. This limitation applies regardless of the legal theory upon which such claim is based.

Members expressly assume all risks associated with fitness activities and agree that Crown Fitness bears no responsibility for injuries, illnesses, property damage, or other losses incurred during facility use or program participation. This limitation of liability applies even if Crown Fitness has been advised of the possibility of such damages. Some jurisdictions do not allow limitation of liability for personal injury, so this limitation may not apply in all cases.

14. Dispute Resolution

Any disputes, controversies, or claims arising from or relating to these Terms of Service, membership agreements, or use of Crown Fitness facilities shall first be attempted to be resolved through good-faith negotiation between the parties. If negotiation does not resolve the dispute within thirty days, the matter may be submitted to mediation before a mutually agreed upon mediator.

If mediation is unsuccessful, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules and procedures. The arbitration shall take place in the jurisdiction where the Crown Fitness facility is located. Each party shall bear its own costs associated with arbitration proceedings. These terms are governed by the laws of Australia, and any legal proceedings shall be subject to the exclusive jurisdiction of Australian courts.

15. Privacy and Data Protection

Crown Fitness collects and processes personal information in accordance with our Privacy Policy and applicable data protection laws. By using our facilities and services, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy. We implement reasonable security measures to protect your information, but cannot guarantee absolute security of data transmitted electronically.

Members have the right to access, correct, or request deletion of their personal information subject to legal retention requirements and legitimate business needs. 16. Modifications to Services

Crown Fitness reserves the right to modify, suspend, or discontinue any aspect of its facilities, programs, services, or operating hours at any time with or without notice. This includes but is not limited to changes in class schedules, equipment availability, facility layouts, program offerings, and service features. We will make reasonable efforts to notify members of significant changes that may impact their membership experience.

Modifications to services do not entitle members to refunds or compensation unless such modifications fundamentally prevent the use of facilities for the primary purpose of the membership. Crown Fitness may temporarily close facilities for maintenance, renovations, special events, or other operational reasons without providing membership extensions or credits except as required by law or individual membership agreements.

17. Force Majeure

Crown Fitness shall not be liable for any failure or delay in performance of its obligations under these terms or membership agreements due to circumstances beyond its reasonable control, including but not limited to natural disasters, public health emergencies, government orders, civil unrest, strikes, equipment failures, utility disruptions, or other force majeure events.

During force majeure circumstances, Crown Fitness will make reasonable efforts to provide alternative services, remote programming, or other accommodations where feasible. Membership obligations and fees may be suspended or adjusted during extended facility closures due to force majeure events, subject to the specific circumstances and applicable legal requirements.

18. Entire Agreement

These Terms of Service, together with any individual membership agreement, program-specific terms, and our Privacy Policy, constitute the entire agreement between you and Crown Fitness regarding use of our facilities and services. These terms supersede all prior agreements, understandings, representations, and communications, whether written or oral, relating to the subject matter herein.

If any provision of these terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The failure of Crown Fitness to enforce any right or provision of these terms shall not constitute a waiver of such right or provision. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
